B.      PUBLIC COMMENTS:  None.

 

C.      APPROVAL OF MINUTES:  March 25, 2010

 

It was moved by Ms. Janna Faulk, seconded by Mr. Jim McPharlin and passed by the following vote to approve and accept the March 25, 2010 minutes.

 

D.      SCHEDULED ITEMS:  MINOR SUBDIVISION COMMITTEE

PROJECT PLANNER: CRAIG SPENCER. ENVIRONMENTAL STATUS: COMBINED DEVELOPMENT PERMIT CONSISTING OF 1) A COASTAL DEVELOPMENT PERMIT TO ALLOW A MINOR SUBDIVISION, TENTATIVE
MAP, TO SUBDIVIDE A 3.38 ACRE PARCEL INTO TWO PARCELS OF 1.87 ACRES (PARCEL A) AND 1.51 ACRES (PARCEL B) RESPECTIVELY; AND 2) A COASTAL ADMINISTRATIVE PERMIT TO CONVERT AN EXISTING 1,002 SQUARE FOOT SINGLE FAMILY DWELLING ON RESULTING PARCEL A TO A SECOND UNIT CONSISTING WITH STATE LAW (CALIFORNIA GOVERNMENT CODE SECTION 65852.2 ET SEQ.). RECOMMENDED ACTION: APPROVE PROJECT.

Mr. Craig Spencer, Project Planner:  Discussed Errata which clarifies conditions and timing in the staff report.

 

Committee Comment:  None.

 

Mr. John Bridges, Fenton & Keller, Representative for Applicant:  Stated Agrees with conditions and errata.  Discussion regarding typographical error to Condition No. 8 PD022 (B)-CONSERVATION AND SCENIC EASEMENT IN THE DEL MONTE FOREST, page 28 under the Timing Column should include prior to issuance of grading and building permits.

 

Public comment: Mr. Joel Panzer, Maureen Wruck Planning Consultants, Discussion regarding letter he submitted before hearing with attached map. Stated the Staff Report is not consistant with the Coastal LUP Policy and disagrees with staffs views. Discussion regarding government code, caretaker’s quarters, second units, legal non-conforming use, over-all lot coverage, density of development, slopes, Coastal regulations, maximum build-out with attached map.  Suggested a variance should be required and the project should be continued to the Planning Commission.

 

Rebuttal: Mr. John Bridges, Fenton & Keller, Representative for Applicant, addressed issues stated by Mr. Joel Panzer, Maureen Wruck Planning Consultants, Discusses and clarification to the Caretaker’s Unit, Legal Non-conforming, Second Unit Law, Pescadero Water Shed Coverage Limitations, Deed Restriction Condition No. 12 in the Staff Report, a Variance is not required, Minor Subdivision Committee is the appropriate Authority, Area is a sufficient level under 20% slope with for slope density rules.

 

Committee Comment: Discussion regarding Gardener’s Cottage, Caretaker’s Unit, Variance, Second Unit Law, Legal Non-Conforming, Maximum Build-out, Slope Density Formula, Pascadero Water, Level of Service, TMC fees, Letter from Joel Panzer attachment H - regarding inconsistency between Committee and Staff.

 

Committee Comment: Mr. Tom Moss, the second unit is consistent with government code, slopes on purposed parcel will allow new development and its planning departments determination if a variance is not required, there are traffic impact fees if an addition car that will be added or additional trips be added, water supply is not an issue for this project. Clarification regarding Condition Number 8 timing should read prior to Final Map.

 

It was moved by Ms. Janna Faulk to approve and adopt a mitigated negative declaration with the attached mitigation and recording program and approve the combined development permit and minor subdivision tentative map based on findings and evidence and subject to recommendations of conditions of approval with the proposed changes to the errata and as discussed today including the changes to the timing in Condition Number 8, seconded by Mr. Jim McPharlin.
